US communications firm Lucent Technologies - currently in the process of merging with Alcatel - are suing Microsoft over a patent called, "Adaptive Coding and Decoding of Frames and Fields of Video".

Lucent are claiming that Microsoft have breached the conditions of the patent, they say, "Microsoft has infringed this patent by releasing the Xbox 360 console, which has MPEG2 technology."

Back in 2003 the Wall Street Journal reported that Microsoft were suing Lucent over a number of patents they hold. Microsoft said they wanted to take them to court, "to prevent Lucent from continued threats on this matter."

It's clear that these two companies have been locked in heated discussions over patents for some time. Microsoft issued action on the firm in August 2005 due to a typo on a patent, which deemed it invalid. Lucent were then forced to change the typo.

Lucent have requested a jury trial.
