Xbox 360 fansite,
TeamXecuter, is reporting a landmark judgement upholding the legal argument that modchips
do not circumvent copy protection.
This means that a case brought against mod-chip site,
MrModchips, for copyright infringement with the ruling that copyright infringement has already taken place before the modchip is used. The upholding of this argument means that all 26 counts levelled against MrModchips have been quashed.
This is a big problem for ELSPA as copyright infringment has been the main-stay of their legal argument against modchipping. MrModchips has been awarded full costs from the successful appeal, further underlining the ruling. We'll leave it to the legal eagles amongst you to discuss whether past defendants brought to the courts by ELSPA would now be in a position to appeal their cases.

I got a modchip for my xbox so i could run XBMC - a bloody great program with good legit uses - not so i could play dodgy games.
I bet this use of the xBox and mod chips really pissed off Microsoft. As with just about every console (appart from the Wii and the portable Nintendos) the hardware is subsidised at launch to bring it down to a reasonable level, profits are made on each game and official accossories instead. With the volume of people buying xBoxs just for XBMC, it must have cost Microsoft a small fortune :)Quote
Reason I got it chipped was to play Parasite Eve as it wasn't released in the UK.
There are plenty other ways now though to run imports, I have a disc here which I bought from same dealer a few years back. You run the disc on the PS2 then once booted select wether you want to run an import game or a different region DVD. Once again you can't run anything copied but imports are fine as are Region 1 DVD's.
Difference here is that the current modchipping scene in most cases are used to run pirated software. Yeah they do allow you to run Homebrew type software which is fine but most people will use them for illegal activity.Quote
